Zamami Village Safety App Terms of Use Agreement

Established: March 1, 2026

Zamami village (the Village, below) has prepared the following Terms of Use Agreement for the Zamami Village Safety App (the Service), which the Village provides and operates to publish disaster information and provide other support services.

Article 1. Terms of Use Agreement, changes thereto, etc.

  1. By using the Service, users of the Service (the Users, below) agree to all the terms of this agreement.
  2. The Village reserves the right to change this agreement, notifying Users of changes and when they apply through information posted via the Service or by other means. However, notifications may not be sent for minor changes that do not substantially affect the content of the agreement (such as the correction of typographical errors).
  3. Unless the Village otherwise stipulates, the updated agreement will come into effect the first time Users use the Service after the updated agreement is displayed within the Service.

Article 2. License

  1. The Village grants Users a non-transferrable, nonexclusive license to the Service in accordance with the terms of this agreement.
  2. The current agreement does not grant Users a license to use upgrades to the Service that may be developed in the future.
  3. The Village may change the features or specifications of the Service without notice to Users.

Article 3. Limitations

  1. The Service includes features that cannot be used outside the environs of the Village. The Village shall not accept liability for any damage or loss suffered by the Users due to these limitations.
  2. The Users use the Service at their own risk. The Village shall not accept responsibility for any actions that the Users take as a result of using the Service, nor for the results of such actions.
  3. The Service periodically establishes a network connection to transmit and receive information. Communication fees are incurred at these times.
  4. Program data and other data required for display and operation of the Service may be automatically changed or updated without notice.
  5. The Service may become temporarily unusable if a network connection is broken (e.g. because the User has moved outside active signal range while the Service is operating), or if the Service cannot establish a transmission link (e.g. because the User is inside a structure or transmission is being blocked by a building).
  6. Communication fees apply when downloading the app for the Service.
  7. The Village reserves the right to post Village or third-party advertisements within the Service.
  8. The display of the location-based functions of the Service may vary depending on the accuracy of the GPS of the device used by the user.
  9. The route display and route guidance functions of this service have not been designed with disaster conditions in mind. The Village shall not accept liability for any damage or loss suffered by the Users due to these limitations.
  10. The Users are responsible for communication fees incurred as a result of using the Service.

Article 4. Restrictions on use and termination of license

The Village reserves the right to restrict usage of features or terminate features of the Service in whole or in part, or to suspend or terminate providing the Service itself. The Village shall not accept responsibility for any damages or loss to Users arising from such feature restriction or termination within the Service, nor from suspension or termination of provision of the Service itself.

Article 5. Authorizations

  1. The rights to any software, apps, content, databases, manuals, or other information associated with the Service, or any other intellectual property rights, belong to the Village or to the rights-holders. The Service is protected by the Copyright Act of Japan and other laws, as well as by international treaties, etc.
  2. Users shall not copy, adapt, publicly transmit, alter, reverse engineer, reverse assemble, reverse compile, or combine with other services (except for the use of functions linked with other services provided on the Service) any of the software, apps, or contents, in whole or in part, associated with the Service.

Article 6. Prohibited uses

  1. Users shall not engage in any of the following actions in using the Service.
    (1) Acts which violate laws, are likely to violate laws, or are similar to acts which violate laws
    (2) Acts which violate this agreement, are likely to violate this agreement, or are similar to acts which violate this agreement
    (3) Acts which infringe upon or are likely to infringe upon copyrights held by the Village or third parties or upon other intellectual property rights
    (4) Acts which interfere with or are likely to interfere with the Village’s ability to provide the Service
    (5) Acts which use the Service in ways or under conditions which hinder or are likely to hinder third party transmissions
    Acts which access computers, telecommunications or other equipment operated by the Village or by third parties in unauthorized ways; cracking; cyberattacks; acts which use the Service in ways or under conditions that obstruct computers, telecommunications or other equipment operated by the Village or third parties; posting information that encourages such acts; or acts which are similar to the above
    (7) Any other acts that use the Service in ways or under conditions that infringe upon the legal protections of others or violate public order or standards of decency
  2. Should the Village deem that a User has engaged in any of the prohibited acts stipulated above, the Village reserves the right to terminate that User’s use of the Service without notice, or to take other reasonable and necessary measures.

Article 7. Transfer of rights

  1. Users may not transfer, assign, or otherwise delegate to a third party any rights or obligations based in this agreement.

Article 8. Disclaimers

  1. The Village does not make any guarantees with regards to performance of the Service, to its fitness for any particular purpose, to accuracy or reliability of results, or to correctness of any other information provided by the Service, and provides no warranties against defects for any of the content provided therein.
  2. The Village shall not accept liability should damages be incurred as a result of the content, use, and other aspects of the Service.
  3. The Village shall not accept responsibility for any damages incurred by the User due to additions, changes, discontinuations, or termination of the Service.
  4. The Village shall not accept responsibility for any damages arising from reduced display speeds or other failures resulting from excessive access or other unexpected factors.
  5. The Village reserves the right to restrict the use of the Service or take any other measures it deems necessary without prior notice towards Users who engage in acts that violate this agreement, or when the Village deems that there are reasonable grounds for believing that a User’s actions are likely to violate this agreement. The Village shall not accept liability for any damages arising from actions it takes in this regard. Users will be deemed to not object to measures that the Village takes based on the above stipulations.
  6. Notwithstanding the stipulations of this agreement, the Village shall not accept responsibility under any conditions for any of the following damages arising from the Service.
    (1) Any damages not attributable to intentional malice or gross negligence on the part of the Village
    (2) Any damages arising from special conditions, regardless of the Village’s foreknowledge of such conditions
    (3) Any damages arising from unavoidable action taken in the course of providing the Service, such as server maintenance

Article 9. Personal information & Privacy Policy

  1. The Village shall handle Users’ personal information as stipulated in laws governing the protection of personal information (Act No. 57 of 2003), and Users agree to allow the Village to handle their User information in this manner.
  2. The Village uses Users’ personal information, Service usage conditions, usage frequency of screens and items, and other statistical data for the purpose of service improvements, operations, and maintenance; and may analyze and/or subject this information to secondary processing to the extent required for statistical surveys. Users agree to allow the Village to use their personal information for statistical surveys and secondary processing.

Article 10. Applicable laws

  1. This agreement is governed by Japanese laws.
  2. Should any questions or disagreements arise between the Village and Users regarding the Service or this agreement, they shall be negotiated in good faith. Should this fail to resolve the issue, they shall be resolved by the Naha District Court as the agreed-upon exclusive jurisdictional court of first instance.

Article 11. Miscellaneous provisions

  1. Should a portion of this agreement be deemed invalid based on laws and regulations, all other provisions and stipulations shall remain in force.
  2. Should a portion of this agreement be deemed invalid or revoked in relation to certain Users, this agreement shall remain in effect with other Users.
  3. The official text of this agreement shall be the Japanese version. Should any contradictions or discrepancies exist between the Japanese version of this agreement and its translated versions, the Japanese version shall prevail.

Supplementary provisions
This agreement shall take effect as of March 1, 2026.
